N.G. was serving a sentence for a prior conviction when he noticed a small hole in the ceiling of his cell. He was able to lay on his bunk and kick a larger hole with his feet. He created an “attic” above his cell, where he put his personal belongings. He says that he was “simply exploring [his] cell, looking for a hiding spot.” He was charged and convicted of escape, attempted escape, and institutional vandalism, and sentenced to eleven to 48 months, consecutive to his first sentence.

N.G. makes clear that he never intended to escape his cell—he was merely exploring. He also claims that there was insufficient evidence to support his conviction for escape, because he never left his cell. He is currently seeking support in filing a Post-Conviction Relief Act petition.


Procedural issues

At trial, N.G.’s defense counsel was related to the judge, which he views as a conflict of interest. He also claims a due process violation because he was only given 3 days to prepare for trial.
